The IL Consumer Coverage Disclosure Act & You

If you are a business owner in Illinois, the recently enacted Illinois Consumer Coverage Act (CCA) affects you. The CCA took effect August 27th, 2021 and requires certain disclosures to your employees about coverages you provide as a business. The CCA does not impose coverage requirements on employers; it only imposes disclosure requirements. The benefits that you as an employer are required to cover may depend on whether your plan is self-funded or fully insured, and whether you are a small employer or a large employer. The list of Essential Health Benefits (EHB) is available for your review here. If you are a client of ours it is over 99% likely you are on a qualified plan and that your policy covers all EHB items. Clients of ours offering plans that are self insured and do not meet EHB have been contacted personally. 

The Consumer Coverage Disclosure Act requires any employer who provides group health insurance coverage to employees in Illinois to provide all employees with a list of essential health insurance benefits regulated by the State of Illinois; as well as a comparison of which of those benefits are covered by the insurance plan that you provide. This also applies to employers whose group health insurance plan is not regulated by the State of Illinois. Employers must provide this information to all employees upon hire, annually, and upon request.


Employers should compare the health benefit coverage provided by each of your group health insurance policies to this chart and indicate which benefits are and are not covered by the policy. You can also view and download disclosure templates for your business here. These documents are only for BCBSIL’s Small Group plans that are non-grandfathered or non-transitional.
